By downloading or using Dram Diary, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the app.
These Terms of Service ("Terms") govern your use of the Dram Diary mobile application and website at dramdiary.com (collectively, the "Service"), operated by Dram Diary ("we", "us", or "our"). By accessing or using the Service, you confirm that you are at least 21 years of age and agree to be bound by these Terms.
You must be at least 21 years of age to use Dram Diary. The Service involves the tracking and discussion of alcoholic beverages. By creating an account, you confirm that you meet the minimum age requirement in your jurisdiction to purchase and consume alcohol, and that you are at least 21 years old. We reserve the right to terminate accounts where this requirement is not met.

You may not share your account with others or create accounts on behalf of third parties without authorization.
You retain ownership of all content you submit to Dram Diary, including bottle entries, tasting notes, ratings, and photos ("Your Content"). By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and display Your Content for the purpose of providing and improving the Service, including generating aggregated and anonymized insights as described in Section 5.
You are solely responsible for Your Content. You agree not to submit content that:
Dram Diary includes community features such as leaderboards and achievement tracking. When using community features, your display name, badge count, and bottle count may be visible to other users. You can control your privacy settings within the app. You agree to use community features respectfully and not to harass, abuse, or harm other users.
We may collect, aggregate, and analyze data from user collections and activity across the Service to create anonymized, de-identified insights ("Community Insights"). These insights may include, but are not limited to:
Community Insights are always presented in aggregate form. We will never publicly identify individual users, their specific collections, or their personal data in any published insight without their explicit consent.
We may use Community Insights for any lawful purpose, including displaying them within the app, publishing them on our website or social media channels, sharing them with media or industry partners, and using them to improve the Service. By using Dram Diary, you consent to the collection and use of your data in this aggregated, anonymized manner.
Community Insights derived from aggregated data are our exclusive property and do not constitute Your Content.
The barcode scanning feature uses third-party data sources to look up bottle information. We do not guarantee the accuracy, completeness, or timeliness of this data. Pricing information displayed in the app is estimated and for reference only — it is not financial advice and should not be relied upon for purchasing or selling decisions.

The Dram Diary name, logo, app design, and all related trademarks are our exclusive property. Nothing in these Terms grants you any right to use our trademarks, trade names, or other proprietary materials without our prior written consent. The Service, including its software, features, and content (excluding Your Content), is protected by copyright and other intellectual property laws.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the Service.
TO THE FULLEST EXTENT PERMITTED BY LAW, DRAM DIARY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
You may delete your account at any time from within the app (Profile → Delete Account). Upon deletion, all your data will be permanently erased within 30 days.
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason with or without notice. Upon termination, your right to use the Service immediately ceases.
We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice. We may also update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
